3. Eligibility

You must be at least 18 years old and have the legal authority to enter into binding agreements to use our Services.

4. Services

Olifant Digital provides digital marketing, advertising, and related professional services. The scope, pricing, and deliverables of services are defined in individual proposals, contracts, or statements of work agreed upon separately.

5. Payments & Fees

Fees, payment terms, and billing schedules are outlined in your individual agreement with Olifant Digital. All payments are non-refundable unless otherwise stated in writing.

6. Intellectual Property

All content, materials, methodologies, and intellectual property provided by Olifant Digital remain our exclusive property unless explicitly transferred in writing.

7. Confidentiality

Both parties agree to keep confidential any non-public business, technical, or financial information disclosed during the course of the engagement.

8. Warranties Disclaimer

Our Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our Services will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, Olifant Digital shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our Services. In no event shall our total liability to you exceed the fees paid by you to Olifant Digital in the three (3) months preceding the claim.

10. Termination

Either party may terminate the engagement in accordance with the terms of the applicable service agreement or statement of work. Upon termination, all outstanding fees become immediately due and payable. Sections covering intellectual property, confidentiality, limitation of liability, and governing law shall survive termination.

11. Force Majeure

Olifant Digital shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, internet outages, or government actions.

12. Governing Law & Jurisdiction

These Terms and any disputes arising from your use of the Services shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the competent courts of the State of New York.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with any applicable service agreement or statement of work, constitute the entire agreement between you and Olifant Digital with respect to the subject matter herein and supersede all prior discussions, representations, or agreements.

15. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting on this page. Continued use of our Services following any changes constitutes your acceptance of the updated Terms.
